Amanullah V. The State,
YLR 2012 661 · Balochistan High Court
This case involves an appeal by three men, Amanullah, Attaullah, and Hidayatullah, who had been convicted by a trial court in Quetta for possessing explosive material and illegal weapons, including a pistol, cartridges, and a hand grenade, allegedly recovered after their car was stopped at a checkpoint. They were sentenced to seven years imprisonment under the Explosive Substances Act, with two of them receiving an additional two-year sentence under the Arms Ordinance.
On appeal, the Balochistan High Court closely examined the evidence and found serious problems with the prosecution's case. Key witnesses gave contradictory accounts about the timing of the arrest and when the police arrived at the scene, undermining the credibility of the arrest and recovery story. No site plan of the location was ever prepared. Additionally, the prosecution failed to properly prove that the expert reports on the explosive material and weapons were actually issued by government-authorized experts, as legally required, and no bomb disposal or crisis management official testified to confirm the authenticity of these reports.
Because of these gaps, contradictions, and procedural failures, the court concluded that the prosecution had not proven its case beyond reasonable doubt. The court acquitted all three appellants, ordering their release unless wanted in another case.
This judgment matters because it reinforces the principle that criminal convictions, especially those carrying severe punishment, must rest on credible, consistent evidence and proper legal procedure, not just police allegations.
