Haji Ghaibi Khan v. The State,

YLR 2012 63 · Balochistan High Court

Haji Ghaibi Khan was tried for shooting and killing Asal Khan and injuring a passer-by, Adel Masih, in Quetta in 2004. The prosecution's case, built on eyewitness accounts, medical evidence, and recovery of a licensed pistol from the accused shortly after the incident, led to his conviction by the trial court, which sentenced him to death under Section 302(b) of the Pakistan Penal Code and ordered him to pay compensation.

On appeal to the Balochistan High Court, the defence tried hard to raise doubts about the timing, date, and presence of witnesses at the crime scene, but failed. The court found the eyewitnesses' statements to be consistent, credible, and free of any personal grudge against the accused, meaning there was no apparent reason for them to falsely implicate him. Medical evidence and a positive chemical report supported their accounts, and the recovered pistol further strengthened the case. The court also clarified that prosecutors are not legally required to call every possible witness—they can choose which ones to present, as long as the case is proven.

Since the murder was committed in cold blood, in a public area of the city, against an innocent victim, the court held there were no grounds for leniency. It upheld both the conviction and the death sentence, finding the trial court's judgment sound and free of legal error.

This case reaffirms established principles in Pakistani criminal law: prosecutors have discretion over which witnesses to produce, and courts will uphold death sentences in clear-cut murder cases where evidence is strong
