Bagan Khan and another V. The State and another,
YLR 2012 580 · Balochistan High Court
This case, decided by the Balochistan High Court in 2011, involved a shooting incident that took place way back in 1993 in a village in Jhal Magsi district. According to the prosecution, a group of armed men attacked a village, killing two shepherds, Mumtaz and Sikandar, and injuring two women, Mst. Sukhan and Mst. Khanzadi. One accused, Pandhi alias Bagan, was tried years later and convicted by the trial court, sentenced to death for the murders and to further imprisonment for the injuries and rioting-related offences. He appealed his conviction, and the trial court also sent the case for confirmation of the death sentence.
The High Court overturned the conviction and acquitted the appellant. It found the prosecution's case deeply flawed: the eyewitnesses were all relatives of the deceased or of each other, one witness was not even named in the initial police report, and other witnesses' statements were recorded after an unexplained 17-year delay. No weapon was recovered from the accused, no ballistic report existed, and no medical or autopsy evidence supported the witnesses' account. The court also noted that a co-accused had already been acquitted on the same evidence, so it would be unfair to convict this appellant on it.
The judgment matters because it reinforces that in serious criminal cases, especially those carrying the death penalty, courts must be extremely cautious about relying solely on interested witnesses without independent, credible corroboration.
