Fateh Muhammad V. The State,

YLR 2012 533 · Balochistan High Court

This case involved Fateh Muhammad, who was accused of robbery and dacoity under sections 392, 395 and 397 of the Pakistan Penal Code. He had initially been denied bail by the Additional Sessions Judge, Kalat. Later, after the parties reached a compromise, the Sessions Judge (who was temporarily holding additional charge of the same court) granted him bail, reasoning that there was an unexplained three-day delay in filing the FIR and that the offence did not fall within the category of crimes where bail is normally barred. However, when the regular Additional Sessions Judge returned, he recalled and cancelled this bail, accusing the defence lawyer of manipulating witnesses and hiding the compromise, even though the offence was legally non-compoundable.

The Balochistan High Court found that the Additional Sessions Judge's reasons for cancelling bail were based on a misreading of the case record and of established legal principles. The compromise had not actually been used as the basis for granting bail—the real grounds were the delay in the FIR and the nature of the offence. The High Court also found no evidence supporting claims that the defence had tampered with witnesses. Concluding that the original grant of bail was proper and its cancellation illegal, the High Court set aside the cancellation order and restored bail to the accused.

The case highlights that bail, once granted on legitimate legal grounds, should not be revoked based on speculation or misinterpretation of facts, and that compromise between parties in a non-compoundable offense is not automatically grounds for denying or c
