Qadir Bakhsh and 2 others V. The State,
YLR 2012 510 · Balochistan High Court
This case involved three men, Qadir Bakhsh, Moula Bakhsh, and Shah Muhammad, who were convicted by a Sessions Court in Sibi for murder under sections 302(b) and 149 of the Pakistan Penal Code and sentenced to life imprisonment plus compensation payments. The prosecution's case relied mainly on one eyewitness, Wazir Khan, who claimed the accused had attacked the victim, Abdul Nisar, with sticks, causing injuries that later proved fatal.
On appeal, the Balochistan High Court found serious problems with the prosecution's evidence. The sole eyewitness had made dishonest improvements to his story during trial, lived far from the scene without a credible reason to be there, and behaved in ways inconsistent with normal human conduct. There was also an unexplained two-and-a-half-hour delay in filing the police report, suggesting the story may have been fabricated. Medical evidence contradicted the eyewitness account, and the prosecution failed to produce another eyewitness mentioned in the initial report, who later testified for the defense that the accused were not the actual culprits. The recovered sticks, allegedly used as weapons, were not proven to have human blood on them.
Given these doubts, the court ruled that the benefit of the doubt must go to the accused as a matter of right, not favor. The convictions were overturned and all three men were acquitted. This case highlights the importance of reliable eyewitness testimony and thorough investigation in securing a fair murder conviction.
