Nasir-Ul-Din V. The State Narcotics Cases,
YLR 2012 490 · Balochistan High Court
This case involved a man named Nasir-ul-Din who was arrested after police found 200 grams of charas (a cannabis derivative) in his possession during a patrol near Duki, in Balochistan. He was charged under Pakistan's Control of Narcotic Substances Act, 1997, and initially denied bail by a Special Judge, who held that the offence was non-bailable and the trial was not likely to be prolonged.
Nasir-ul-Din then applied to the Balochistan High Court for bail. His lawyer argued that although 200 grams of charas were recovered, only 5 grams had actually been sent for laboratory analysis, and even if he were convicted based on that small sample, he was unlikely to face more than a year's imprisonment. Since bail cannot be used as a form of punishment, he argued he deserved to be released pending trial.
The High Court agreed. It explained that while the law generally bars bail in cases carrying the death penalty, an exception exists for cases that are "fit" for bail, such as those needing further investigation or those involving a small quantity of narcotics. The court held that since only 5 grams out of 200 were sent for analysis, this qualified as a fit case, and the offence did not fall under the strict no-bail rule. The court granted bail, requiring a surety of Rs. 50,000.
This case matters because it clarifies how courts assess "meagre quantity" in narcotics cases and confirms that bail should not function as punishment before conviction.
