Muhammad Hayat V. The State,

YLR 2012 474 · Balochistan High Court

This case involved the murder of Abdul Nabi, a schoolteacher, who was allegedly lured away by three men including Muhammad Hayat under the pretext of a tea party and then shot dead with a Kalashnikov. The trial court in Dera Allah Yar convicted Hayat under section 302(b) of the Pakistan Penal Code and sentenced him to death, also ordering him to pay compensation to the victim's family. Hayat appealed his conviction, while the trial court simultaneously referred the death sentence to the High Court for confirmation, as required by law.

The Balochistan High Court examined the evidence, including eyewitness testimony, the recovery of the murder weapon from the accused, and a positive firearms expert report. Although the witnesses were relatives or close to the deceased, the court held that this alone did not make their testimony unreliable, especially since the crime occurred in daylight and the witnesses' accounts were consistent with medical and forensic evidence. The court therefore upheld the conviction, ruling that the prosecution had proven its case beyond reasonable doubt.

However, the court found that the motive alleged in the initial police report had not been proven with solid evidence. Because of this gap, the judges decided that the death penalty was not justified, and instead converted the sentence to life imprisonment. The compensation order remained in place, and Hayat was given credit for time already spent in custody. This case illustrates how Pakistani courts distinguish between confirming guilt and deciding on the severity of punishment.
