Abdul Jabbar V. The State,
YLR 2012 442 · Balochistan High Court
This case involved Abdul Jabbar, who was convicted by a Special Judge in Quetta under the Control of Narcotic Substances Act, 1997, and sentenced to life imprisonment plus a fine, after 170 kilograms of charas was allegedly found hidden in secret cavities of a pickup truck he was driving. He appealed to the Balochistan High Court.
The High Court found problems with how the prosecution handled the evidence. Although 170 kilograms was allegedly recovered in 140 packets, only small samples (10 grams each from 10 packets, totaling 100 grams) were initially sent for chemical testing. There was no proof that samples were taken from every packet to confirm the entire recovery was actually charas. Samples were also sent to the Chemical Examiner about seven months after arrest, with no explanation of where the drugs were kept meanwhile, breaking the chain of custody. The court also noted that any additional evidence the investigators later tried to introduce should have gone through proper legal procedure under the Criminal Procedure Code, not informally.
Because of these gaps, the court ruled the prosecution had only proven possession of 100 grams of charas, not the full 170 kilograms. Since the accused had already been in custody since January 2008, the court ordered his sentence be treated as already served.
This case matters because it highlights the importance of proper evidence handling and chain of custody in narcotics cases, and shows courts will not convict based on incomplete or improperly obtained forensic evidence.
