Shafi Muhammad and another V. The State,
YLR 2012 416 · Balochistan High Court
This case involved two men, Shafi Muhammad and Akbar, who were convicted by a trial court for murder and sentenced to life imprisonment after allegedly killing a man during a nighttime attack near a canal in Balochistan. The prosecution's case rested mainly on eyewitness testimony from relatives of the deceased, an alleged extra-judicial confession, an identification parade, and recovered weapons.
The Balochistan High Court overturned the conviction and acquitted both men. The judges found serious problems with the evidence. The witnesses were closely related to each other and hostile toward the accused, making their testimony unreliable without independent support. They also failed to name the accused until five days after the incident, despite claiming to have recognized them that night - raising doubts about whether they actually saw the attackers. The alleged joint confession was legally inadmissible, and the identification parade was contradictory, since witnesses admitted it was too dark to identify anyone yet still picked out the accused. Medical evidence didn't match the witness accounts, and weapons were recovered ten days later in a manner (joint recovery) not permitted by law.
The court emphasized that supporting evidence like recoveries or medical reports cannot substitute for solid, direct evidence of guilt. Since the core evidence was too weak and contradictory, the men could not be lawfully convicted, and their life sentences were set aside.
