Niaz Muhammad Khoso v. Government of Balochistan,

YLR 2012 374 · Balochistan High Court

This case involved a government employee, Niaz Muhammad Khoso, who had won an appeal before the Balochistan Service Tribunal in March 2010. The Tribunal had set aside the order removing him from service and directed the relevant government authority to reconsider the withdrawal action against him after giving him a hearing, within one month. However, the government did not comply with this order, so the petitioner approached the Balochistan High Court asking it to direct the authorities to implement the Tribunal's judgment and reinstate him with back benefits.

The High Court did not rule on the merits of his reinstatement claim. Instead, it examined whether the petitioner had another proper legal route to get the Tribunal's order enforced. The Court noted that under Section 5(2) of the Balochistan Service Tribunals Act, 1974, the Service Tribunal is treated as a civil court when deciding appeals, and therefore has all the powers of a civil court under the Code of Civil Procedure, including powers to enforce its own judgments. This meant the petitioner could go back to the Tribunal itself and ask it to enforce compliance with its earlier order, rather than seeking a fresh remedy through a constitutional petition in the High Court.

Because this alternate and effective remedy existed, the High Court disposed of the petition, advising the petitioner to approach the Tribunal directly for enforcement. This case clarifies that Service Tribunals have enforcement powers akin to civil courts, guiding civil servants on the correct forum for enforcing tribunal judgments.
