Hidayatullah Peerzada v. Khalid Zaman,

YLR 2012 316 · Balochistan High Court

This case involved a landlord-tenant dispute over a shop in Quetta under rent control law. The landlord had previously tried, unsuccessfully, to evict the tenant on grounds of needing the shop for demolition, reconstruction, and personal business use—that earlier attempt failed all the way up to the Supreme Court. Later, the landlord filed a second eviction application, this time claiming the shop was needed for his own personal use and for his son, who was said to be jobless. The tenant argued this second attempt was made in bad faith since a similar personal-need argument had already been rejected before, and claimed the landlord already owned other commercial properties suitable for his business.

The Rent Controller ruled in the landlord's favor, ordering the tenant to vacate. The tenant appealed to the Balochistan High Court.

The High Court dismissed the appeal, holding that the landlord had proven the shop was genuinely needed for himself and his son, and that the tenant failed to disprove this. The court held that a landlord has the right to choose which of his properties to use personally, and running one business already does not bar him from starting another. Importantly, the court ruled that a second eviction application is legally permissible on new or different grounds if genuine need arises later, and such an application cannot be rejected merely because an earlier one on different grounds had failed, so long as there is no bad faith.

This judgment matters because it clarifies landlords' rights to file fresh eviction applications based on evolving personal needs, without being permanently barred by a prior unsuccessful attempt.
