Muhammad Akbar v. State,
YLR 2012 2686 · Balochistan High Court
This case is about Muhammad Akbar, who was caught as a passenger on a bus at a police checkpoint near Quetta with six kilograms of charas (hashish) hidden in a sack on his lap. He was tried and convicted under Pakistan's Control of Narcotic Substances Act, 1997, and sentenced to five years in prison plus a fine. He appealed to the Balochistan High Court, arguing that the police witnesses' testimony contained contradictions, that the bus driver and cleaner should have been called as witnesses, that only 30 grams of the recovered material had actually been sent for chemical testing, and that there was a five-day delay in sending the samples to the Chemical Examiner - all of which, he argued, should entitle him to be acquitted or at least have his sentence reduced to match only the 30 grams tested.
The High Court rejected these arguments and upheld the conviction. It found that minor inconsistencies among police witnesses were not significant since they agreed on the key facts - date, time, place of arrest, and recovery of the drugs. It held that police officers are just as credible as ordinary witnesses unless the defense can show specific bias or hostility against the accused. The delay in sending samples for testing did not matter because there was no claim that the evidence had been tampered with. Finally, the court ruled that sending the entire recovered substance for testing is not legally required - a small representative sample is enough to prove the whole quantity was contraband. The appeal was dismissed, confirming the importance of consistent core testimony over minor procedural discrepanc
