Haji Ghulam Mohammad v. Haji Anwar Jan & others,
YLR 2012 2670 · Balochistan High Court
This case arose out of a civil dispute in which the petitioner, Haji Ghulam Muhammad, had earlier been allowed by the High Court, in an appeal, to produce a specific witness named Nazar Muhammad to support his case. However, Nazar Muhammad had become an absconder after being booked in a murder case, making it impossible to bring him to court. The petitioner then asked the trial court (Majlis-e-Shoora, Loralai) to let him produce a different witness who was already named in his original list of witnesses, and also to allow him to submit certain additional documents. The trial court rejected this request, and the petitioner challenged that rejection through a civil revision petition before the Balochistan High Court.
The High Court dismissed the petition, holding that it was not maintainable. It explained that under the law, decisions about whether to admit or refuse oral or documentary evidence do not qualify as a "case decided" under Section 115 of the Civil Procedure Code, which is the provision that allows revision petitions. Since the trial court's order was simply about evidence, it could not be challenged through a revision. The court also noted the documents in question had not been mentioned or attached to the original plaint, violating procedural rules.
This case matters because it clarifies that rulings on evidence-related matters during a trial generally cannot be immediately challenged in higher courts through revision petitions; they must wait for the final decision in the case.
