Fida Hussain v. Ghulam Mohammad & others,

YLR 2012 2625 · Balochistan High Court

This case concerns a property dispute that reached the Balochistan High Court on a civil revision petition. The petitioner had originally filed a civil suit seeking possession, mesne profit, and injunctions, based on a 1984 sale agreement under which he had sold property to the respondent. The buyer had paid part of the price but allegedly failed to pay the remainder within the agreed nine-month period, meaning, according to the seller, the agreement stood rescinded and the earnest money forfeited. The trial court decided the case in the seller's favor without specifically framing an issue on limitation, even though the buyer had raised it in his written statement. On appeal, the Additional District Judge set aside that decision and sent the case back to the trial court, directing it to properly address the limitation question and give both sides a fair hearing before deciding again on the merits.

The seller challenged this remand order in the High Court, arguing it was unnecessary since enough evidence already existed to decide the case outright. The High Court disagreed and upheld the remand. It held that limitation is not simply a matter parties can raise or ignore through their pleadings; courts have an independent duty to examine it, since limitation law is mandatory and cannot be waived by the parties or overlooked by the court. Because this issue had not been properly examined below, sending the case back for a fresh, focused hearing on limitation was correct. The case illustrates the mandatory nature of limitation law in Pakistani civil litigation.
