Ghulam Mohammad v. Fida Hussain,
YLR 2012 2560 · Balochistan High Court
This case involved a property dispute in Quetta between Ghulam Muhammad and Fida Hussain. Ghulam Muhammad had sold his property to Fida Hussain in 1984 for Rs.95,000, with Rs.25,000 paid upfront and the remaining amount due within nine months, failing which the agreement would be cancelled and the earnest money forfeited. Ghulam Muhammad claimed Fida Hussain never paid the balance and sued for possession, mesne profits, and injunctions. The trial court framed only limited issues, none specifically addressing whether the suit was filed within the legal time limit (limitation period), and ultimately ruled in favor of Ghulam Muhammad. On appeal, the Additional District Judge sent the case back to the trial court, instructing it to specifically examine the limitation issue and give both parties a fair hearing on that point before deciding the case again.

This case reinforces that limitation is a f
