Abdul Salam Khan V. Muhammad Yaqoob Bangulzai,
YLR 2012 2379 · Balochistan High Court
This case is about a legal dispute over a water supply order issued by a Judicial Magistrate in Sanjavi, Balochistan. The Magistrate had used Section 133 of the Criminal Procedure Code, a law meant to address public nuisances like blocked roads or health hazards, to order Public Health Department officials to continuously supply water to residents of Sanjavi bazaar and its surrounding areas. Officials were also told to post a surety bond of Rs. 200,000 each, forfeitable if they failed to supply water.
The Public Health official challenged this order directly in the High Court, which quashed it, ruling that the Magistrate had misused Section 133, a provision meant for removing physical nuisances or obstructions, not for compelling ongoing service delivery like water supply. The High Court called it an abuse of legal process.
The original complainant then filed this review application, arguing he was a necessary party who was never heard, and that the official had bypassed proper procedure by going straight to the High Court without his knowledge.
The High Court dismissed the review application. It held that not including the complainant did not violate his rights, since it was the official who was aggrieved by the Magistrate's order, and the State had already been made a party in the case. The Court reaffirmed its power to quash unlawful orders to prevent abuse of judicial process, even without hearing every affected party. This case clarifies the limited scope of Section 133 and reinforces courts' authority to correct jurisdictional overreach by lower courts.
