Mahmood Ahmed v. The State,
YLR 2012 2314 · Balochistan High Court
This case involved a man, Mahmood Ahmed, who was sentenced to death by a trial court in Quetta for murder under Section 302(b) of the Pakistan Penal Code. He appealed to the Balochistan High Court, and the case also came before the court as a Murder Reference for confirmation of the death sentence, as required by law in capital cases.
The High Court found serious problems with the prosecution's case. No one had actually witnessed the murder, and even the complainant was not an eyewitness. The accused was only named four days after the incident, based on secondhand information from someone who also had not seen the crime. The accused's confession came after four days of unexplained police custody, raising suspicion that it may have been obtained through pressure rather than given voluntarily. The court noted that a retracted confession cannot support a conviction unless proven truthful and corroborated by other evidence. Additionally, the alleged motive was never proven, the recovery of the murder weapon was questionable due to inconsistencies, and forensic evidence (crime shell casings) was sent for testing more than two weeks after being collected, further undermining reliability.
Given these gaps and unexplained inconsistencies, the court held that the prosecution failed to prove guilt beyond reasonable doubt. It set aside the death sentence, acquitted Mahmood Ahmed, and ordered his release. The judgment underscores the importance of solid, corroborated evidence and proper procedure before convicting someone, especially in cases carrying the death penalty.
