Abdul Malik was stopped at a Levies check post while driving a car, and 13 packets of charas weighing 13 kilograms were allegedly found hidden in the vehicle's secret cavities. A sample of 100 grams was sent for chemical analysis, and he was convicted by the Special Judge, CNS Khuzdar, under section 9(c) of the Control of Narcotic Substances Act, 1997, and sentenced to life imprisonment plus a fine.
On appeal, his lawyer argued the case was weak because it wasn't clear the 100-gram sample truly represented all 13 packets (a mix of rods and slabs), the sample was sent for testing after a two-and-a-half-month delay, the drugs weren't weighed at the scene, and recovery paperwork wasn't prepared on site. He also claimed he was merely a paying passenger in a company vehicle, not the sole driver.
The Balochistan High Court rejected these arguments. It found that prosecution witnesses consistently confirmed the accused was driving alone, he showed no proof of a bus ticket or company ownership, and there was no evidence of ill will by the police against him. The court held that delay in sending samples, or preparing paperwork away from a remote checkpost, did not automatically make the case false, especially since possession of the drugs and vehicle was clearly established. The conviction and life sentence were upheld, showing courts will maintain drug convictions despite procedural delays if the core evidence of possession remains credible and unchallenged.
