Murad Vs. Syed Muhammad & others.,
YLR 2012 2115 · Balochistan High Court
This case involved a family property dispute in Balochistan. Murad filed a lawsuit claiming his rightful Islamic law share of ancestral property left by his grandfather, which was jointly owned by him and his relatives (the respondents). The respondents contested the case, disputing property boundaries and arguing the suit was time-barred, though they admitted the family relationship. They also claimed Murad's mother had waived her share in the property years earlier.
The trial court (Qazi, Pasni) heard evidence from both sides and ruled in Murad's favor, granting him his share. However, when the respondents appealed, the appellate body (Majlis-e-Shoora, Turbat) reversed this decision and dismissed the suit entirely.
Murad then took the matter to the Balochistan High Court, arguing that the appellate court had not properly justified its reversal of the trial court's decision. The High Court agreed. It found that the appellate court had issued only a brief order without genuinely re-examining the evidence or explaining its reasoning, violating Order XLI, Rule 31 of the Civil Procedure Code, which requires appellate courts to give solid, evidence-based reasons whenever they overturn a lower court's decree.
The High Court ruled this failure made the appellate judgment legally unsustainable. It set aside the appellate court's decision and sent the case back for a proper, reasoned re-examination. This case reinforces that appellate courts cannot simply overturn decisions without demonstrating they seriously engaged with the evidence and legal issues involved.
