Mst. Hoora ors. v. Allah Dad.,
YLR 2012 2070 · Balochistan High Court
This case is about a property dispute involving the Islamic law right of pre-emption, which allows certain people (like adjoining landowners) to claim first right to purchase property before it is sold to someone else. To exercise this right validly, a specific legal procedure called Talbs must be followed, which requires the claimant to make formal demands at particular stages, with details of when, where, and in front of which witnesses these demands were made.
In this case, the respondent sued for cancellation of a property sale and asserted his pre-emption rights. The trial court and the appellate court (Majlis-e-Shoora) both ruled in his favor, partly because the defendants had not seriously contested the claims in their written statement. The petitioners challenged this in the Balochistan High Court, arguing that the plaint itself was legally defective because it failed to properly plead the required Talbs.
The High Court agreed with the petitioners. It found that simply using the word "Shifa" was not enough, and that evidence about the Talbs could not be introduced later through witnesses if it was missing from the written pleadings. Since these details were essential prerequisites for a valid pre-emption suit, the plaint should have been rejected under Order VII, Rule 11 of the Civil Procedure Code. As a result, the High Court set aside the decisions of both lower courts and allowed the revision petition.
This case matters because it reinforces strict pleading requirements in pre-emption suits, emphasizing that courts must properly scrutinize plaints at the outset rather than allowing defective claims to proceed based on later testimony.
