Muhammad Adnan v. State,
YLR 2012 2056 · Balochistan High Court
This case concerns a bail application filed by Muhammad Adnan, who was accused of murdering Ghulam Rasool along with a co-accused, in a case registered under section 302 (murder) read with section 34 of the Pakistan Penal Code.
The FIR was initially registered against unknown persons after the victim was found dead in his house. During investigation, a co-accused named Ali Khan was questioned and revealed the names of others involved, including the applicant. Based on Ali Khan's disclosure, police recovered a digital camera and prize bonds from Ali Khan's house, and recovered a mobile phone and prize bonds belonging to the deceased from the applicant's house.
The applicant's lawyer argued that there was no real evidence linking him to the crime, and that the only evidence was an inadmissible extra-judicial confession made to police.
The Balochistan High Court rejected this argument, ruling that the recovery of stolen items from the applicant's house, based on the co-accused's pointation, counted as "discovery of new facts" under Article 40 of the Qanun-e-Shahadat Order, 1984 (Pakistan's law of evidence). This meant the evidence was legally significant, not just an inadmissible confession.
Since the alleged offense carried the death penalty or life imprisonment, it fell under a legal category where bail is generally not granted except in special circumstances. Finding no such special circumstances, the court dismissed the bail application, while directing the trial court to proceed with the case quickly.
