Lal Muhammad V. Abdullah and others,

YLR 2012 200 · Balochistan High Court

This case involved an appeal against the acquittal of two men, Abdullah and Lal Muhammad, who had been accused of murdering a man named Jehangir during a violent incident in Balochistan. According to the prosecution, the deceased and others were chasing people who had stolen a tractor when a group of accused persons opened fire with Kalashnikovs, killing Jehangir. The motive alleged was a dispute over a marriage between the appellant's son and the daughter of one of the accused.

After trial, the Additional Sessions Judge acquitted both respondents, and the complainant, Lal Muhammad, challenged these acquittals before the Balochistan High Court.

The High Court examined the evidence and upheld the acquittals. It noted that although eight people were named as accused, the actual fatal shooting was attributed only to one absconding accused, not the respondents. No weapons were recovered from the respondents to support the eyewitness accounts, and despite claims of heavy firing by multiple attackers, only four bullet casings were found at the scene, raising doubts about whether the witnesses had truly seen the event as described.

The court explained that appeals against acquittal are treated with extra caution, and interference is only warranted where there is clear error or injustice. Since the prosecution's case suffered from significant doubt, the court applied the principle that such doubt must benefit the accused, and dismissed the appeals, confirming the acquittals.
