Muhammad Lal v The State,
YLR 2012 1771 · Balochistan High Court
This is a jail appeal decided by the Balochistan High Court in a murder case. Muhammad Lal had been convicted by a trial court for killing Nadir Khan and sentenced to ten years imprisonment plus payment of diyat (compensation) to the victim's heirs. He appealed, arguing he was falsely implicated due to a personal grudge and tribal feud, and asked for his sentence to be reduced and to be excused from paying diyat because of his poor financial condition.
The prosecution's case relied mainly on the accused's confessional statement, since there were no direct eyewitnesses and the physical evidence, like the recovered knife and forensic reports, was not conclusively linked to the crime. The defense argued the confession was recorded after a suspicious seven-day delay and had been retracted, so it could not support a conviction.
The High Court examined whether the confession was voluntary and true, and whether it was corroborated by other evidence. It found that the accused never complained of torture or coercion when he had the opportunity before the magistrate, and that the confession matched the facts of the case and was supported by other evidence. The court upheld the conviction, ruling that a retracted confession can still support a conviction if it is voluntary, true, and corroborated. It also clarified that diyat payments must not be less than the value of 30,630 grams of silver, though courts can consider parties' financial circumstances in fixing the amount. The appeal was dismissed.
