Murad Bukhsh  V. The State,

YLR 2012 153 · Balochistan High Court

This case is about a man named Murad Bukhsh who was convicted for forgery under Section 465 of the Pakistan Penal Code, after a Land Cruiser vehicle he claimed to own was found to have a fake number plate. The plate was actually registered to someone else. A trial court and then an appellate court both convicted him and sentenced him to one year's imprisonment plus a fine.

Bukhsh challenged this conviction before the Balochistan High Court. His lawyer argued that the evidence only showed a fake number plate existed, not that Bukhsh himself had made it, and that no witness could actually confirm the vehicle or plate was recovered from his possession.

The High Court agreed. It found that the complainant admitted he never personally saw or recovered the vehicle from Bukhsh, and the police recovery witness could not say from whom the vehicle was actually taken. The court also noted that there was no evidence the accused had personally created the forged plate, which is a key requirement for a forgery conviction under Section 465. The court even suggested the charge, if anything, should have been framed differently, under a provision dealing with using a forged document rather than making one.

Because the prosecution failed to produce solid evidence linking Bukhsh to the forgery, the High Court ruled that both lower court judgments were unsafe and unjust. It set them aside and acquitted him. The case highlights how criminal convictions require actual proof, not assumptions.
