Majeed and another V. The State,
YLR 2012 148 · Balochistan High Court
This case is about a murder trial from Jhal Magsi, Balochistan. According to the prosecution, the complainant and his two brothers were grazing cattle when four armed men opened fire on them, killing one brother (Afzal Khan) and wounding another (Sohrab Khan). One of the accused, Majeed, was arrested and tried, while the others remained unidentified or unavailable for trial. The trial court convicted Majeed of murder and related offences and sentenced him to death, along with lesser sentences for the injuries caused and orders to pay compensation to the victims.
Majeed appealed, but his lawyer did not ask for a full acquittal. Instead, he argued that since four people were accused of firing, it could not be proven exactly whose bullet killed the deceased, so the death penalty was too harsh.
The Balochistan High Court agreed with this narrower argument. It found that the eyewitnesses were credible and consistent, their presence at the scene was natural, and the accused's flight after the incident supported his guilt. However, because it could not be established which of the four assailants actually fired the fatal shot, the court held that a death sentence was not justified. It upheld Majeed's conviction but reduced his sentence from death to life imprisonment.
This case matters because it illustrates how courts handle uncertainty about individual responsibility in group crimes, especially when deciding between life and death sentences.
