Khudai Dad alias Pehlwan V. The State,

YLR 2012 1355 · Balochistan High Court

This case involved a man, Khuda-e-Dad alias Pehalwan, convicted of murdering Miran Jan and injuring another man, Muhammad Khan, by firing at them near Refugee Camp No.5 in Quetta on 1 June 2006. The trial court sentenced him to life imprisonment for murder, plus additional sentences for attempted murder and causing injury. He appealed his conviction, while the complainant separately sought enhancement of his sentence to death.

The Balochistan High Court examined the evidence, including testimony from two prosecution witnesses who were relatives of the deceased. The court held that being related to the victim does not automatically make witnesses unreliable, especially when their account is consistent, supported by medical evidence, recovered weapons, and forensic lab reports, and when the crime occurred in broad daylight, ruling out mistaken identity. Finding no serious contradictions in the evidence, the court upheld the conviction and dismissed the appellant's appeal.

On the question of enhancing the sentence to death, the court noted the killing was not premeditated, the accused had not initiated the encounter, and the real motive was never disclosed by the prosecution. Given also a six-year delay in the case, the court declined to increase the punishment and dismissed the complainant's revision petition.

The judgment matters because it reaffirms two principles: relatives' testimony can still be credible if corroborated by other evidence, and death sentences should not be imposed where premeditation and motive remain unclear.
