Shahid Hakeem V. Altaf Hussain Agha and another,
YLR 2012 134 · Balochistan High Court
This case involved a dispute over agricultural land in Lasbella, Balochistan. Altaf Hussain Agha, who had purchased property through a court auction, complained that Bolan Casting Limited and its representatives had illegally occupied part of his land. He filed a complaint under the Illegal Dispossession Act, 2005. The trial court convicted Shahid Hakeem, who was associated with the company, sentencing him to two years imprisonment, a fine, and compensation.
Hakeem appealed to the Balochistan High Court, arguing that he had joined the company only after the alleged encroachment took place, and that mere continuation of managing land already enclosed by boundary walls did not prove criminal intent on his part, which the law requires.
The High Court examined the evidence and agreed that while some encroachment onto the complainant's land had indeed occurred, the case had originally been filed against the company's Managing Director, and Hakeem's name was added later without proper justification, even though he was not present when the encroachment happened. The court clarified that under the Illegal Dispossession Act, a conviction requires proof of both an unlawful act and criminal intent to grab property, not just occupation or encroachment. Since Hakeem lacked the necessary intent, his conviction could not stand.
The court set aside his conviction and sentence, acquitting him. This case is significant because it clarifies that criminal liability under the Illegal Dispossession Act requires clear proof of intent, and individuals cannot be held liable merely for administering property they inherited control of from others.
