Aurangzeb v. The State,
YLR 2011 62 · Balochistan High Court
This case involved Aurangzeb, who was convicted by an Anti-Terrorism Court in Quetta for illegal possession of a loaded Kalashnikov magazine with 30 live cartridges, under the West Pakistan Arms Ordinance, 1965. He was sentenced to three years' rigorous imprisonment plus a fine. He appealed to the Balochistan High Court, arguing that no firearm was actually recovered from him and that the trial court had wrongly mixed up evidence from a separate, related case.
The High Court examined the prosecution's evidence closely and found serious problems. The police witnesses gave conflicting accounts of the timing of the incident and the recovery, with unexplained discrepancies between their oral testimony and the written report. The name of the person who delivered the report to the police station was also inconsistent. Crucially, the investigating officer admitted he did not conduct an independent investigation, merely taking custody of a carbon copy of the recovery document and statements already prepared by others. A private witness listed in the recovery memo was never brought to court, and there was no explanation for why he was even present at the scene, since he did not live nearby.
Given these unexplained contradictions and gaps, the court ruled that the prosecution had failed to prove the weapon was actually recovered from Aurangzeb's possession. Since recovery itself wasn't established, the question of licensing became irrelevant. The court set aside the conviction and acquitted him, highlighting how sloppy investigation and inconsistent evidence can undermine a criminal case.
