M/s Allied Precision Engineering v. Jhanda Khan Maree,
YLR 2011 3055 · Balochistan High Court
This case involved workers who were terminated from their jobs at a company manufacturing auto parts. The company claimed these workers were actually employed by an outside contractor, not directly by the company, so labour laws protecting employees didn't apply to them. The workers filed grievance petitions, and both the Labour Court and the Appellate Tribunal ruled in their favor, finding they were genuine employees of the company and ordering their reinstatement with full back pay. The company then challenged this before the High Court.
The High Court upheld the finding that the workers were indeed company employees, not contractor employees. It laid out key factors for making this determination: who has administrative control over the worker, who has power to hire and fire, whether the work is permanent and tied to the manufacturing process, who pays wages, and whether the contractor is a genuine business or merely a sham to avoid labour law obligations. Evidence showed the company controlled these workers, paid them directly, and kept them on staff even as different contractors came and went - proving they were the company's real employees.
However, the court modified the back-pay award. It ruled that such compensation isn't meant to punish employers but only to make up for the worker's actual job loss. Since the workers hadn't proven they remained unemployed throughout the entire period after termination, the court reduced full back-benefits to just three months' pay, presuming that's a reasonable time to find alternate work.
This case matters because it clarifies how courts determine true employment relationships despite contractor arrangements, protecting workers from being wrongly excluded from labour law protections through disguised contracting.
