Haji Mehrab Khan v. Mst. Bibi Wahida,

YLR 2011 3013 · Balochistan High Court

This case is about a property dispute involving the Islamic legal right of pre-emption (Shufa), which allows certain people—such as neighboring landowners or co-sharers—to claim priority in buying property before it is sold to an outsider. Haji Mehrab Khan, who owned agricultural land adjacent to a property in Kuchlak, Quetta, sued to claim pre-emption rights after the adjoining land was sold to two buyers. He argued he had properly asserted his claim through the required legal steps known as Talbs (formal demands): Talb-e-Muwathibat (immediate claim upon hearing of the sale), Talb-e-Ishhad (formal reaffirmation with witnesses), and Talb-e-Khusumat (filing a lawsuit).

The trial court dismissed his suit, and he appealed to the Balochistan High Court. The High Court examined whether he had actually proven he performed these Talbs correctly. It found major gaps: his plaint and notice did not specify the exact date, day, or time he learned of the sale, nor did they name the witnesses before whom he supposedly made his first claim (Talb-e-Muwathibat).
