Akram V. Nazar Ali,
YLR 2011 2969 · Balochistan High Court
This case concerns a land dispute in Killa Abdullah district, Balochistan, where a group of plaintiffs claimed ownership of certain agricultural land, alleging that revenue records had wrongly recorded portions of the land in the names of the defendants due to errors during a settlement operation in 1963-64. The plaintiffs sought a court declaration confirming their ownership, cancellation of the disputed revenue entries, and an injunction preventing the defendants from transferring the land.
The defendants opposed the suit, pointing out that an earlier case involving the same parties and the same land had already been litigated and decided, including a prior civil revision before the High Court itself. The trial court rejected the plaint, holding that the matter was barred by the legal principle of res judicata, meaning the same issue between the same parties had already been conclusively decided in earlier proceedings and could not be relitigated.
The Balochistan High Court upheld this decision. It ruled that since the earlier suit had already determined the ownership and possession issues between the same parties over the same property, the new suit was barred under Section 11 of the Civil Procedure Code. The court noted this legal bar could be raised and decided at any stage of the case. Consequently, the plaintiffs' revision petition was dismissed.
This judgment reinforces the importance of the res judicata principle in preventing repeated litigation over settled property disputes, promoting finality and judicial efficiency.
