Ghulam Jillani v The State,

YLR 2011 29 · Balochistan High Court

This case is about a man convicted for possessing 19 kilograms of heroin found in a vehicle he was driving, under Pakistan's Control of Narcotic Substances Act, 1997. He and three others were arrested during a routine patrol near the Pakistan-Iran border, with heroin recovered from one vehicle and a satellite phone from another that was allegedly guiding it. After trial, one co-accused was found to be a minor and tried separately, two others were acquitted before trial for lack of evidence, and the appellant alone was convicted and sentenced to life imprisonment plus a fine.

On appeal, his lawyers argued the investigation was flawed because the investigating officer wasn't properly authorized, never visited the crime scene, and didn't prepare a site plan, and that procedural requirements under the law weren't followed.

The Balochistan High Court rejected these arguments. It held that the investigating officer had been properly authorized by a judicial magistrate, and no bad faith by police was proven. Importantly, the accused never denied owning the vehicle or the drums containing the drugs, nor claimed he was merely transporting them for someone else. This meant he was in conscious, knowing possession of the narcotics. Finding no major contradictions in the prosecution's case and considering the sentence appropriate for such a serious crime, the court dismissed the appeal and upheld his life sentence.
