Moulvi Naqal-ud-Din v. Abdullah,
YLR 2011 2843 · Balochistan High Court
Naqal-ud-Din sued to claim pre-emption rights over two plots of land in Muslim Bagh, Balochistan, arguing that he had a superior right to acquire the land because of his adjoining property rights and that he had properly performed the legally required demands (Talbs) needed to claim pre-emption. Under Islamic pre-emption law as applied in Balochistan, a claimant must make two specific demands quickly and correctly: Talb-e-Muwathibat, an immediate assertion of the right upon learning of the sale, and Talb-e-Ishhad, a follow-up demand made before witnesses referencing the first demand. The trial court had dismissed his suit, and he appealed.
The High Court upheld the dismissal. It found that the appellant failed to prove he had properly performed either demand: the person who allegedly informed him of the transaction was never produced as a witness, his own witnesses gave contradictory accounts of when and how the demands were made, and he never even mentioned the first demand while describing the second. The court also noted that the appellant had admitted during cross-examination that the transaction was actually an exchange of properties, not a sale, and only sales (not exchanges) can be subject to pre-emption claims.
This case matters because it reinforces that pre-emption rights are not automatic or informal privileges but require strict, timely, and well-evidenced compliance with procedural requirements, and that only genuine sales—not property exchanges—qualify for such claims.
