Muhammad Bakhsh v. the State,
YLR 2011 2768 · Balochistan High Court
This case involved four men — Muhammad Bakhsh, Zulfiqar, Zulqarnain, and Rahim Bakhsh — convicted by a Sessions Court and sentenced to life imprisonment for the murder of Azizullah, allegedly killed in a family dispute over agricultural land. They appealed to the Balochistan High Court.
The High Court found serious flaws in how the trial had been conducted. Most importantly, witness statements had been recorded in violation of Section 360 of the Criminal Procedure Code, which requires that a witness's testimony be read back to them so they can correct any inaccuracies before it is finalized. The court held that this procedural lapse caused real prejudice to the accused and undermined the fairness of the trial, amounting to a miscarriage of justice. The court also stressed that judges must actively ensure fairness in criminal trials, not merely act as passive referees, especially in capital cases where an accused's life is at stake.
Examining the evidence, the court found that none of the eyewitnesses had actually implicated one of the accused, Rahim Bakhsh, in the crime. He was therefore acquitted and ordered released immediately. For the remaining three accused, the court set aside the conviction and sent the case back to the trial court for a fresh trial, conducted properly this time.
The case highlights the importance of correct procedure in criminal trials and the courts' duty to actively safeguard fairness, particularly where severe punishments are involved.
