Haji Sanaullah V. Khaliq Dad,

YLR 2011 2721 · Balochistan High Court

This case involved a dispute over land in Kharan, Balochistan. Haji Sanaullah claimed he owned a piece of land, saying he had bought it through a chain of transactions originally from the family of Khaliq Dad. When he found Khaliq Dad, his wife, and two sons working on the land with a tractor, he filed a police complaint accusing them of criminal trespass under sections 447 and 147 of the Pakistan Penal Code.

A Judicial Magistrate examined the complaint and acquitted the accused early in the proceedings under section 249-A of the Criminal Procedure Code, which allows a magistrate to dismiss a case if there is no reasonable chance of conviction. Sanaullah appealed this acquittal to the Balochistan High Court.

The High Court upheld the magistrate's decision. It found that ownership and possession of the land were genuinely disputed, that it was unclear whether the chain of purchase Sanaullah relied on was valid, and that a civil suit over ownership of the same land was already pending in civil court. The court noted that at best Sanaullah had only symbolic, not actual, possession. Given this uncertainty, the court held that people with a legitimate claim to land cannot be criminally prosecuted for trespass simply for entering it, especially while ownership remains unresolved in civil litigation.

This case illustrates that criminal trespass charges should not be used to resolve what are essentially civil property disputes, and that criminal courts require clear proof of exclusive rights before convicting someone of trespass.
