Dr. Saba Durrani v. Chairman House Allotment Committee,
YLR 2011 2657 · Balochistan High Court
This case is about a dispute over a government-allotted house in Quetta. Dr. Saba Durrani had been officially allotted House No. C-3 in Wahdat Colony after it became vacant following Abdul Sattar Khajjak's retirement from government service. Khajjak had initially been allowed to keep living in the house for six months post-retirement, but instead of vacating it, he obtained another order from the Chief Minister extending his retention for a full year, even though the applicable rules did not allow this.
Dr. Durrani challenged this extension in court, arguing that under the Residential Accommodation at Quetta (Procedure of Allotment) Rules, 2009, retired civil servants cannot keep official housing beyond six months, and that the Chief Minister had no authority to override this rule.
The Balochistan High Court agreed with her. It held that while the Chief Minister generally has power to relax certain rules, this power did not extend to letting someone occupy government housing indefinitely in violation of clear, specific rules. The court also rejected Khajjak's argument that he could keep the house until alternate accommodation was found for his son, noting the son's grade did not qualify him for that type of house.
The court declared the extension order illegal and void, and directed that vacant possession of the house be handed over to Dr. Durrani. The case reinforces that government authorities cannot bypass clear housing rules through discretionary orders, and that civil servants are not obligated to follow illegal directives.
