Muhammad Imran Tehseen v Ejaz Lodhi,
YLR 2011 2407 · Balochistan High Court
This case from the Balochistan High Court dealt with what happens to a court order attaching property when the underlying lawsuit is later dismissed. A recovery suit for over Rs. 41 lakh had been filed, and during the proceedings the trial court ordered the defendant's property to be attached, or alternatively required a bank guarantee, to secure the amount in dispute. This is a legal tool used before a final judgment to prevent a defendant from disposing of assets that might be needed to satisfy a future decree. While the petitioner's challenge to that attachment order was pending before the High Court, the trial court dismissed the original suit, and an appeal against that dismissal was filed.
The key legal question was whether the earlier attachment order survived the dismissal of the suit, especially since an appeal was still pending. The High Court held that under the law governing such attachments, once a suit is dismissed, the attachment automatically ends, even if the trial court does not explicitly say so in its order. The pendency of an appeal does not revive the attachment, and even if the appellate court later overturns the dismissal and sends the case back for further proceedings, the attachment does not automatically come back into effect. A party wanting the attachment reinstated must apply afresh for it at that stage.
This matters because it clarifies that protective measures like pre-judgment attachment are tied strictly to the life of the original suit and cannot be assumed to continue through appeals. The court accordingly dismissed the revision petition.
