Mehmood Khan v. Muhammad Ibrahim,

YLR 2011 2169 · Balochistan High Court

This case is about a landlord-tenant dispute under Pakistan's rent laws. A shop owner (the landlord) applied to evict his tenant from a shop, claiming he needed the premises for his own personal use after retiring from government service, and also alleging the tenant was a poor rent-payer. The Rent Controller in Pishin accepted the eviction application and ordered the tenant to vacate within three months. The tenant appealed, arguing that the landlord hadn't specified what kind of business he planned to start, that the landlord was too old (about 75) to run a business, that he had four sons already employed as government servants, and that he owned other properties besides this shop, suggesting he really just wanted to sell the shop at a higher price rather than use it himself.

The Balochistan High Court rejected all these arguments and dismissed the appeal. It ruled that a landlord doesn't need to specify the exact nature of the business he intends to start, nor prove where his capital will come from. Old age alone doesn't disprove genuine need, especially since the landlord could be assisted by his sons. The court also held that even if a landlord wants to eventually sell a property, that doesn't invalidate a genuine claim for personal need. Finally, it confirmed that landlords owning multiple properties can choose which one they want for personal use, and tenants cannot dictate which property the landlord should keep for himself. This case reinforces landlords' rights to reclaim property for bona fide personal use.
