Shah Nawaz V. The State,
YLR 2011 2146 · Balochistan High Court
This case involved an appeal by two men, Shah Nawaz and Nadir Ali, who had been convicted of murder and sentenced to life imprisonment by a trial court in Quetta for killing Muhammad Naeem in 2008. The complainant also filed a separate petition asking the court to increase their punishment.
The prosecution's version was that the two accused shot the deceased with a Kalashnikov for unknown reasons. However, the defense argued that the deceased had actually attacked the accused first with a knife, causing them serious injuries, and that the accused had registered their own police complaint about this attack before the murder case was filed against them.
The Balochistan High Court examined the evidence and found inconsistencies in the prosecution witnesses' accounts, noting they conveniently left out the injuries suffered by the accused. The court concluded there was no advance planning or shared intention (common intention) between the two accused to commit murder, so the legal provision holding both men equally responsible for a joint criminal act could not apply to Shah Nawaz.
