Muhammad Iqbal v. The State,

YLR 2011 2031 · Balochistan High Court

This case involves a bail application filed by Muhammad Iqbal, who was accused of robbing a man of his motorcycle and mobile phone at gunpoint in Quetta. According to the complainant's account, two men on a motorcycle stopped him, one showed a pistol and threatened him, and they took his motorcycle and phone. The applicant was later identified by the complainant during a police identification parade and was charged under robbery laws and a provision dealing with armed robbery (Haraabah) under the Offences Against Property Ordinance.

The applicant's lawyer argued that his client was falsely implicated, that the identification parade was improperly conducted by police and had no legal value, that the armed robbery provision didn't apply since there was no mention of a murderous attack, and that there was an unexplained delay in filing the police report.

The Balochistan High Court rejected all these arguments. It found no evidence of any prior enmity between the accused and complainant that might suggest false implication, held that using a pistol to snatch property clearly fit the definition of armed robbery, said it couldn't rule on the identification parade's legality at the bail stage since doing so might unfairly affect either side's case, and found no real delay in filing the complaint. Since the trial court had properly evaluated the evidence and used its discretion correctly, the High Court declined to interfere and dismissed the bail application, while allowing the applicant to reapply for bail later if new grounds emerged during trial.
