Haji Amanullah v. Haji Javed & others,
YLR 2011 2012 · Balochistan High Court
This case involved a landlord-tenant dispute in Quetta over a shop on Masjid Road. The landlord filed an eviction application against his tenant, claiming the tenant had stopped paying rent since December 2006, had illegally sublet the shop to a third party, and that the landlord genuinely needed the shop for his jobless son to start a garment business. The tenant disputed the landlord-tenant relationship and contested the claims.
After an earlier ex parte decision was set aside and the case sent back for a proper hearing, the trial court framed key issues and heard the landlord's witnesses. However, the tenant himself never appeared to give his own statement, despite being granted multiple adjournments. All proceedings were instead handled through his attorney, and no affidavit was filed explaining the tenant's absence. The trial court eventually closed the tenant's side and ruled in favor of the landlord, ordering eviction.
The tenant appealed, arguing he had been unfairly denied the chance to testify due to being abroad in Dubai and unable to get a flight. The High Court rejected this argument, finding that the repeated requests for delay without any supporting affidavit appeared to be a tactic to stall proceedings rather than a genuine difficulty. The court held that the trial court's judgment was thorough and well-reasoned, and dismissed the appeal, upholding the eviction order.
This case illustrates how courts scrutinize claims of unfairness when they appear to be delaying tactics, and reinforces that parties must act with good faith and provide credible evidence
