Mst. Parveen Akhtar v Syed Wasay Agha,
YLR 2011 1999 · Balochistan High Court
This case from the Balochistan High Court involved a dispute over property ownership between Mst. Parveen Akhtar (and another petitioner) and Syed Wasay Agha (and others). The petitioners had filed a civil suit seeking a declaration that they owned certain property, along with possession and an injunction against interference by the respondents. The trial court dismissed the suit without taking evidence, ruling it was not maintainable due to lack of a valid cause of action. The appellate court upheld this dismissal, citing insufficient court fees, vague dates for when the cause of action arose, and an unexplained earlier withdrawal of a similar suit.
The High Court found that both lower courts had misapplied the law. It held that the burden was on the defendants, not the plaintiffs, to prove the suit was barred due to an earlier withdrawal. It also clarified that under the Civil Procedure Code, a suit cannot be dismissed merely for non-joinder or misjoinder of parties, since courts have the power to add or remove parties at any stage. Additionally, the court noted that if there was an issue with court fees, the trial court should have given the plaintiffs a chance to correct it, rather than assuming failure and dismissing the case outright.
As a result, the High Court set aside both lower court orders and sent the case back to the trial court for a fresh decision. This judgment matters because it reinforces procedural fairness, ensuring that technical objections don't unjustly block legitimate claims from being heard on their merits.
