Peer Bakhsh v. Rasool Bakhsh,
YLR 2011 1954 · Balochistan High Court
This case concerns a land dispute in Lasbella, Balochistan. The respondents (Rasool Bakhsh and others) had filed a civil suit claiming ownership and possession of a piece of land, seeking cancellation of a lease that had been granted to the petitioners (Peer Bakhsh and others), and asking for an injunction to stop them from occupying it.
The trial court dismissed the suit at an early stage without recording any evidence, ruling that it was barred by limitation (filed too late, after 30 years) and that the plaintiffs had no legal claim as owners or lessees. The plaintiffs challenged this before the District Judge, who accepted their revision petition, set aside the trial court's order, and sent the case back for a full trial with evidence from both sides, since it involved disputed facts as well as legal questions.
The petitioners then approached the Balochistan High Court, arguing the District Judge had wrongly interfered and that the original dismissal was correct. The High Court disagreed, holding that questions like limitation and ownership could not be decided merely on assumptions or written statements alone, especially when both sides disputed the facts. Such issues required proper evidence. The Court upheld the District Judge's order, dismissed the petition, and directed the trial court to involve the provincial government since the land's status appeared unsettled. This case underscores that courts should not dismiss suits on technical or factual disputes without allowing parties to present evidence.
