Abdul Zahir v. The State,

YLR 2011 1853 · Balochistan High Court

This case is about a violent clash in Killa Saifullah, Balochistan, in February 2009, where a group of men attacked two brothers working in their fields, resulting in one brother's death and injuries to the other. The accused were armed with farming tools like spades and rods, not weapons. The trial court convicted Abdul Zahir of murder under Section 302(c) of the Pakistan Penal Code, sentencing him to 25 years imprisonment, while another accused, Abdul Khaliq, was convicted of causing hurt. Both appealed to the Balochistan High Court.

The High Court examined the evidence, including eyewitness testimony and medical reports, and found the trial court's overall assessment of guilt to be sound—the complaint was filed promptly, the accused were clearly named, and their three-month disappearance without explanation suggested guilt. However, the court disagreed with the murder conviction. It found no evidence of premeditation or intent to kill; the accused used farming tools, not weapons, and the death arose from a sudden fight rather than a planned attack. Therefore, the court reclassified the offense from qatl-e-amd (intentional murder) to a lesser category under Section 315 (qatl shibh-i-amd), reducing Abdul Zahir's sentence to 14 years imprisonment under Section 316.

This case matters because it illustrates how courts distinguish between different degrees of culpable homicide under Pakistani law based on intent, weapon use, and circumstances, ensuring punishment matches the true nature of the crime.
