Syed Abdul Jabbar v. The State,
YLR 2010 3271 · Balochistan High Court
Syed Abdul Jabbar was convicted by a Special Judge under the Control of Narcotic Substances Act, 1997 and sentenced to life imprisonment plus a fine, after police allegedly recovered a huge quantity of charas (about 42 kilograms, made up of 1978 rods and 67 cubes) from bags he was carrying at a bus stop in Quetta. He appealed to the Balochistan High Court, arguing that the evidence was unreliable, that witnesses contradicted each other, and that proper procedure was not followed in testing the recovered material.
The High Court agreed with him. It found that although a very large quantity of narcotics was allegedly recovered, the investigators only sent a small sample of 100 grams to the forensic laboratory for testing, without identifying or separating which specific rods or cubes the sample came from. Given the huge number of individual pieces, the law required proper sampling from each item to confirm that all of it was actually a narcotic drug. The witnesses also contradicted each other on important points. The court held that this carelessness and failure to follow proper procedure by the investigating agency created real doubt about whether the narcotics were genuinely recovered from the accused as claimed.
Because of this reasonable doubt, the court ruled that the benefit of doubt must go to the accused. It set aside the trial court's judgment and acquitted him, highlighting how sloppy police investigation and evidence handling can undermine even serious drug prosecutions.
