Siraj Ahmed v. The State,
YLR 2010 3230 · Balochistan High Court
This case involved Siraj Ahmed, who was convicted by an Additional Sessions Judge in Lasbella for possessing an unlicensed dagger under the Pakistan Arms Ordinance, 1965, and sentenced to three years' rigorous imprisonment plus a fine. He appealed from jail, seeking acquittal and claiming he had been falsely implicated.
The background was that Ahmed had allegedly walked into a police station holding a dagger and confessed to killing a man named Ghulam Muhammad and injuring another person, surrendering himself. Since he could not produce a license for the dagger, a separate case was registered against him for illegal weapon possession. Separately, the victim's family had also filed a murder case naming him as the accused.
The Balochistan High Court found a critical contradiction: the murder case FIR recorded the incident as happening at 11:30 p.m., while the weapons case FIR (based on his alleged confession) stated the incident occurred at 11:30 a.m. the same day. This meant, oddly, that Ahmed appeared to confess before the murder had even been reported. Additionally, key witnesses to the weapon recovery were never produced in court, weakening the evidence.
The Court ruled that these unexplained inconsistencies created reasonable doubt, and this doubt must benefit the accused. It found the trial court had failed to properly consider these facts. As a result, the High Court overturned the conviction and acquitted Ahmed, ordering his release. This case underscores how contradictions in police records can undermine
