General Manager, WTR, PTCL, Quetta v. Daily Meezan,

YLR 2010 3173 · Balochistan High Court

This case involved a dispute between PTCL (the telephone company) and Daily Meezan, a newspaper subscriber, over unpaid telephone dues. PTCL had issued notices under Section 81 of the West Pakistan Land Revenue Act, 1967, demanding that Daily Meezan pay outstanding dues of over Rs. 5.7 lakh on its telephone connection within 15 days. When the dues were not paid, PTCL disconnected the phone. Daily Meezan claimed the old telephone number had simply been changed to a new one, that its bills were fully paid, and that the disconnection was illegal. It sued for a declaration that it was the lawful subscriber and for an order restoring its phone connection.

The trial court ruled in favor of Daily Meezan, but the appellate court partially reversed that decision. Both sides then filed revision petitions before the Balochistan High Court.

The High Court examined the evidence and found that Daily Meezan had, in its own letters, admitted owing money and had asked to pay in installments and to avoid disconnection. This contradicted its court claim that nothing was due. The Court held that Daily Meezan was in fact a defaulter and could not deny liability merely to escape payment. It concluded that Daily Meezan failed to prove its case, while PTCL had proven its claim of unpaid dues.

The case matters because it shows courts will rely on parties' own written admissions and conduct over their later claims in litigation, and that customers cannot escape valid debts through inconsistent legal arguments.
