YLR 2010 3144 · Balochistan High Court

This case involved a group of students who obtained LLB degrees from a Quetta campus of Al-Khair University, a university originally established in Azad Kashmir. When they applied to the Balochistan Bar Council to be enrolled as advocates, their applications were rejected because the Pakistan Bar Council had passed a resolution declaring that Al-Khair University was not recognized for enrolment purposes. The students challenged this refusal in the Balochistan High Court.

The court noted that Al-Khair University's degrees had been recognized as equivalent by Pakistan's Higher Education Commission. However, since the university had no territorial jurisdiction within Pakistan, its Quetta campus needed proper affiliation with the local University of Balochistan, which had not actually happened. The University of Balochistan had merely issued a No Objection Certificate, which the court clarified is not the same as formal affiliation.

Despite this technical shortfall, the court found that the students had enrolled and completed their degrees in good faith, reasonably believing the campus was properly affiliated, before the Pakistan Bar Council's resolution was passed. The fault lay with the two universities, not the students. Penalizing the students for this institutional failure would be discriminatory. The court therefore directed the Bar Council to accept and process their enrolment applications, allowing the petitions.

This case matters because it protects students who acted in good faith from being punished for administrative failures by educational institutions beyond their control.
