Atta Muhammad v. State,
YLR 2010 300 · Balochistan High Court
This case involved a couple, Atta Muhammad and Mst. Shah Gul, who asked the Balochistan High Court to cancel a police case (FIR) filed against them under Pakistan's Hudood laws for alleged abduction. The woman's mother had filed the complaint claiming her daughter was abducted by the man with help from his brothers. However, the couple presented a marriage certificate (Nikah Nama) showing they had married voluntarily two days before the alleged abduction was reported.
When the case came before the court, the woman herself appeared and confirmed she had married of her own free will, was not abducted, and wished to remain with her husband. She also revealed she was pregnant. Even the State's own lawyer, after speaking privately with the woman, confirmed there was no coercion involved. The complainant mother later admitted in court that her real objection was that the marriage happened without her permission, and she offered to withdraw the complaint only if the husband's family provided a bride for her son in exchange—an offer the court did not endorse.
The Chief Justice ruled that since the alleged victim denied being abducted and confirmed a free, valid marriage, there was no actual offense to prosecute. Citing Supreme Court precedent, the court held that continuing the case would be an abuse of judicial process meant merely to harass the couple and settle personal scores. The FIR was quashed, and police were directed to ensure the couple's safety. This case illustrates how courts can intervene to stop misuse of criminal law in family disputes over marriage choices, particularly protecting adults
