Miss Asma Gulistan v. Taraqee Foundation through Chief Executive,

YLR 2010 2868 · Balochistan High Court

This case involved a woman who worked for Taraqee Foundation as a Credit Officer. The organization sued her for recovery of about Rs. 11,96,207, alleging she had misappropriated funds and abused her position. After earlier proceedings and an appeal that sent the case back to the trial court for a decision on the merits, the woman failed to appear despite being served through newspaper publication. As a result, the trial court proceeded against her ex parte (without her participation) and ultimately decreed the suit against her.

Ten months later, she applied to have the ex parte decree set aside, claiming she never knew about the case because she believed her lawyer was handling it and was busy working in another district. She also asked the court to excuse the long delay in filing her application. The trial court rejected this request, finding no merit in her explanation, and she appealed to the High Court.

The High Court upheld the trial court's decision. It held that negligence by one's own lawyer is not a valid excuse for such a long delay, and that a person who neglects their own legal rights must bear the consequences. Since she failed to prove a genuine reason for both her absence and the delay, the appeal was dismissed.

This case reinforces an important principle: courts expect litigants to stay informed about their own cases and to act promptly, and blaming one's lawyer alone will not justify years-long delays in seeking relief.
